TERMS OF SERVICE

1. AGREEMENT TO TERMS
These Terms of Service constitute a legally binding agreement between you, whether personally or on behalf of an entity ("Client"), and Ferges ("Company," "we," "us," or "our"), concerning your access to and use of our video editing and content strategy services.
2. SERVICES & WORKFLOW
Ferges provides high-end video editing, motion graphics, and post-production services.
- Quote & Scope: All projects begin with a defined scope and quote. Changes to the scope after work begins may require a new quote.
- Turnaround Time: Estimated delivery dates are provided upon project acceptance. We strive to meet all deadlines but are not liable for delays caused by slow Client feedback or delayed asset transfer.
3. INTELLECTUAL PROPERTY & OWNERSHIP
Ownership: Upon receipt of full payment, Ferges grants the Client exclusive, perpetual, worldwide rights to the final video deliverables.
Portfolio Rights: Ferges reserves the right to use the final deliverables and/or snippets of the work for promotional purposes (e.g., website portfolio, social media showreels) unless a Non-Disclosure Agreement (NDA) has been signed precluding this.
Rights Reservation: Until full payment is received, Ferges retains all legal rights and ownership of the work product. Usage of unpaid work is a violation of international copyright law.
4. PAYMENTS, REFUNDS & CANCELLATION
Payment Terms: Invoices are due upon receipt. For projects exceeding $500, a 50% upfront deposit is required before work commences.
Refunds: Due to the nature of creative work, refunds are generally not issued once work has begun.
Kill Fee: If a Client cancels a project mid-stream, a "kill fee" proportional to the work already completed (minimum 25% of the total quote) will be charged.
5. REVISION POLICY
We offer unlimited revisions to ensure your satisfaction, subject to the following fair-use conditions:
- Revisions must be requested within 14 days of delivery.
- Revisions are for adjustments to the agreed-upon scope (e.g., pacing, color, music choice).
- Requests that constitute a "change of direction" (e.g., "actually, let's use a totally different script/footage") are considered new projects and will be billed accordingly.
6. CONFIDENTIALITY
We understand the sensitive nature of unreleased content. Ferges agrees to keep all Client footage, data, and business information strictly confidential. We are happy to sign a separate NDA upon request.
7. LIMITATION OF LIABILITY
Ferges is not liable for any indirect, consequential, or special damages arising from the use of our services, including but not limited to loss of revenue or data. Our total liability shall not exceed the amount paid by the Client for the specific project.
